These Terms of Service (“Terms”) govern your access to and use of the FreeLunchDaily website, dashboards, and related services (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility and Accounts

• You must be at least 18 years of age to create an account or use the Services in a commercial capacity.
• You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
• You agree to provide accurate and current information and to update it as needed.

2. Visitors and Points

Visitors may earn points through participation in activities such as spinning the wheel, referring friends, entering drawings, and other engagement tools we may offer.

• Points do not represent cash and have no independent monetary value.
• We may modify, limit, or discontinue points, rewards, or drawings at any time.
• We may adjust or revoke points in cases of error, suspected fraud, or misuse.

3. Business Users and Listings

Businesses that join FreeLunchDaily may create listings, post deals, and participate in free lunch promotions under separate Business Promotion Terms, which may be presented during deal or promo setup.

• Businesses are responsible for the accuracy of their listings and offers.
• Businesses must comply with applicable laws, including consumer protection and advertising rules.
• FreeLunchDaily is not the merchant of record for goods or services offered by businesses through the platform.

4. Acceptable Use

You agree not to use the Services to:

• Engage in unlawful, harmful, fraudulent, or misleading activities.
• Post or transmit content that is defamatory, harassing, discriminatory, or hateful.
• Interfere with or disrupt the operation of the Services or the experience of other users.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Use automated tools (bots, scripts) to manipulate points, entries, or platform features.

5. Third-Party Offers and Links

The Services may include links to third-party websites, offers, or services. These third parties are independent of FreeLunchDaily, and we are not responsible for their content, policies, or actions. Your interactions with third parties are solely between you and the third party.

6. Intellectual Property

FreeLunchDaily and its licensors retain all rights, title, and interest in and to the Services, including trademarks, logos, and original content. You may not copy, modify, distribute, or create derivative works based on the Services without our prior written consent.

7. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, FreeLunchDaily disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee the availability, accuracy, or reliability of any deal, promotion, or business listing. Businesses are solely responsible for honoring their offers, and any disputes between visitors and businesses should be resolved between those parties.

8. Limitation of Liability

To the maximum extent permitted by law, FreeLunchDaily and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services.

In no event shall FreeLunchDaily’s total liability for any claim related to the Services exceed the greater of (a) the amounts, if any, you paid to FreeLunchDaily for use of the Services during the six (6) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars (US $100).

9. Indemnification

You agree to defend, indemnify, and hold harmless FreeLunchDaily and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your content or conduct, or your violation of these Terms or applicable law.

10. Changes to the Services and Terms

We may modify or discontinue parts of the Services at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date above. Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Kentucky, and you consent to the jurisdiction of those courts.
